What quorum is required for a general assembly?
The general assembly can only validly deliberate if certain quorum conditions are met.
In Belgium, the general assembly of co-owners can validly deliberate if more than half of the co-owners are present or represented, and they hold at least half of the shares in the common parts.
First convocation: Attendance quorum required. Second convocation: If the quorum is not reached, a second assembly can be convened which may deliberate regardless of the number of co-owners present.
Voting majorities:
- Simple majority (50% + 1): routine decisions
- 2/3 majority: works on common parts
- 4/5 majority: modification of statutes
- Unanimity: change of building purpose
